  Terms & Conditions Terms and Conditions Applying to the Use of Bed Check Wales www.bedcheckwales.co.uk by the accommodation provider and the Customer. The Bed Check Wales system (BedCheckWales.co.uk) are part of Your Tourism Community Ltd (YourTourismCommunity.co.uk). Costs Annual fee £150 per business (A business may have multiple letting properties) Optional services and charges Initial Set-up fee if you wish us to set up for you: £75 per accommodation Annual update. If you wish us to make the annual changes to your tariff, short break weeks and web4-u information: £75 per accommodation Commission charges Commission is only charged on bookings that originate from our marketing efforts and not on any bookings that come from the accommodation providers own advertising and website. 0% on all bookings that originated from the accommodation providers own website. 5% on all booking that are accepted via The Bed Check Wales system Trial Period Accommodation providers are welcome to set up an account and run it of a period of 30 days. If after the trial period they do not wish to continue using the system their account will cease and they will not be charged. However, if after 30 days they decide to continue to use the Bed Check Wales system the will be invoiced for 12 months from the date the trial commenced. They will also be invoiced for any commission accrued during the trial period. Bookings made with the Bed Check Wales system All bookings made with the Bed Check Wales system form a contract only between the accommodation provider and the parties making the booking. Bed Check Wales is specifically not a party to any such booking contract and accepts no liability for any claims or complaints made against the accommodation provider. Display of Cancellation Policy It is a condition of the use of the Bed Check Wales system and Services that the accommodation provider will display a clear and unambiguous cancellation policy fully compliant with any necessary legal requirements by entering the details in the appropriate section of the Administration facility of the Services. Bed Check Wales is not liable for any disputes arising between the accommodation provider and their customers as a result of implementing this policy. Quality of Accommodation The accommodation provider acknowledges BedCheckWales.co.uk and Your Tourism Community Ltd has no responsibility for problems arising from the quality of accommodation or service provided to clients making bookings through the Bed Check Wales system. Accuracy of Information - Prices and Payment Bed Check Wales and its suppliers have taken reasonable care to ensure that the content of the website delivering the Services is accurate. The accommodation provider acknowledges and accepts that Bed Check Wales cannot be held responsible for any inaccuracies in such information. Bed Check Wales is not responsible for any information which the accommodation provider may enter into the Bed Check Wales system. The accommodation provider acknowledges that Bed Check Wales does not have any control over the prices the accommodation provider charges to their clients making use of the Services. Also the accommodation provider is responsible for ensuring that the tariff and the prices quoted are correct. The accommodation provider can alter the financial variables at any time and should use the "Pricing Test " system to ensure they are correct. No Guarantee of Continuous Access to Bed Check Wales Bed Check Wales cannot guarantee continuous access without interruption to its Services, nor do Bed Check Wales guarantee secure access to its services. The performance of Bed Check Wales may be interfered with by many factors outside our control. No liability for any losses incurred by the subscriber/accommodation provider from interruption to or corruption of the Services will be accepted under any circumstances. Complaints Any complaint regarding the business activities of the accommodation provider is not the responsibility of Bed Check Wales. Indemnity The accommodation provider agrees to indemnify and hold harmless Bed Check Wales from and against any liability damage or loss including legal fees and expenses that are incurred as a result of any action, inaction or omission by the accommodation provider. Consequential Loss Under no conditions and in no event shall Bed Check Wales or its suppliers be liable for any consequential or special damages or losses, however arising (including, but not limited to negligence or breach of this terms and conditions or otherwise) or for any loss of property, data, profit, revenue or business, however caused even if that loss or damage was foreseeable by or the possibility of it was brought to the attention of Bed Check Wales Limitation of Liability Notwithstanding the forgoing, Bed Check Wales liability to the accommodation provider in any and all circumstances are limited to the lesser or either::- The amount paid by the accommodation provider for the initial set up of the Services excluding any regular monthly licence fees, or £250.00 - whichever is the lesser. Assignment The accommodation provider may not assign, convey, subcontract or delegate any rights, duties or obligations hereunder except with the written consent of Bed Check Wales. Intellectual Property The accommodation provider acknowledges that all copyright, trademarks and other intellectual property rights in and relating to the Bed Check Wales system are solely owned by or licensed to Bed Check Wales. The content or data found on the system may not be reproduced, sold, transferred or modified without the prior written consent of Bed Check Wales. Neither may the accommodation provider modify, duplicate, display, copy, reproduce, license, publish, transfer or sell any information, software, products or services obtained from the system without the prior written consent of Bed Check Wales. The accommodation provider further acknowledges that he/she must not use any of these intellectual property rights, or the Bed Check Wales Services, except to the extent necessary to use the Services in the manner anticipated by these terms and conditions. General Conditions applying to these terms and Conditions Amendment to These Terms and Conditions Bed Check Wales reserve the right to amend these Terms and Conditions at any time. Updates will be effective 5 days after they are posted on the Bed Check Wales website. Headings The headings used in these Terms and Conditions are included for convenience only and shall not define, extend, limit or otherwise affect these Terms and Conditions. Entire Agreement These terms contain the entire agreement between Bed Check Wales and the accommodation provider and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter and may not be amended or modified unless expressly agreed by Bed Check Wales in writing. © Your Tourism Community Ltd - All Rights Reserved 2025
